In addition to including a new Condition No. 16, Mr. Pavan requested the <br />Commission to delete Condition No. 30 and modify Condition No. 8 to read "27 <br />feet." <br />Commissioner Narum moved to approve PDR-717, subject to the <br />Conditions of Approval as listed in Exhibit B of the staff report, with the <br />following modifications: (1) Condition No. 8 is modified to increase the <br />building height by six inches to 27 feet; (2) Condition No. 16 is modified to <br />require the applicant to plant evergreen trees on the south side of the <br />property to create a vegetative screen, with the types, numbers, and sizes <br />of the trees to be determined by the Planning Division; and (3) Condition <br />No. 30 is deleted. <br />Commissioner Olson seconded the motion. <br />Chair Blank referred to numbers of LEED points and noted that it is surprising <br />that the Conditions of Approval requires only 50 LEED points versus 70 LEED <br />points. Mr. Pavan explained that when the Condition was drafted, the 50 points <br />required by the ordinance was used; the 70 points would require some <br />verification at the building permit stage. He noted that the condition could be <br />changed to prefer 70 points, to be verified at the building permit stage. <br />Chair Blank said stated that this would be dependent upon the maker of the <br />motion. He noted that this is the first developer who has come forward with a <br />new property, this is a lot more real than Ponderosa's in terms of moving forward. <br />Ms. Decker explained that the Code actually requires a minimum of 50 points, <br />and any project which comes forward requires 50 points. She stated that it may <br />appear that all developments are all greater than 50, but this is not the case. <br />Chair Blank noted that when staff meets with the developers and encourages <br />them to bring forward the LEED points, it will at least be 50; but the reality is that <br />the City does not know how many points there will actually be until the project is <br />built. Ms. Decker said that if this project needed a variance and it came in with <br />50 LEED points, she would be less flexible to grant the variance. Chair Blank <br />agreed, but noted that his point was that for at least 80 percent to 90 percent of <br />the developments last year, developers did not indicate how many LEED points <br />they were providing. <br />Commissioner O'Connor inquired if Condition No. 30 was being deleted. <br />Ms. Decker said yes. She explained that this condition is one placed on <br />commercial projects and states that there shall be no truck deliveries, parking lot <br />sweeping, outdoor maintenance, and garbage pickup between 10:00 p.m. and <br />6:00 a.m. She noted that for residential construction, there were also <br />construction hours that limited building from 8:00 a.m. to 50 p.m. <br />PLANNING COMMISSION MINUTES, July 9, 2008 Page 35 of 39 <br />
