Commissioner O'Connor inquired whether this was aworst-case scenario that <br />would most likely not reflect this number of trips. Mr. Tassano replied that this <br />would be the most active senior numbers but not the worst-case scenario. <br />Ms. Harryman referred to a question posed by Commissioner Fox regarding <br />children living on-site. She clarified that the restrictions on who can and cannot <br />live in a senior housing development are set forth in the California Civil Code <br />Section 51.3. She noted that there are only two situations where children or <br />grandchildren can live in a senior facility: (1) when the children or adult children <br />are disabled and need the parent to take care of them; or (2) if the child or adult <br />child is the senior's health care provider and is taking care of the parent(s). She <br />added that the statute states that the care must be substantial in nature, must <br />provide assistance with necessary daily activities or medical treatment, or both. <br />She concluded that these two situations would be the only time that children <br />would be seen living in this community and that children of caregivers are not <br />included. <br />Commissioner Fox inquired if the Homeowners Association, through its CC&R's, <br />would monitor any complaints involving a caregiver who is related to a resident <br />and has children living with the caregiver in the resident's home. Ms. Harryman <br />confirmed that it would be done by the Homeowners Association, possibly on a <br />private level. <br />Chair Blank suggested taking a break before opening the public hearing. <br />Chair Blank called fora 10-minute break at 8:27 p.m. <br />Chair Blank reconvened the regular meeting at 8:37 p.m. <br />THE PUBLIC HEARING WAS OPENED. <br />Pamela Hardy, Ponderosa Homes, stated that this project is the last remaining <br />portion of the master plan for the Busch Ironwood Project which was approved in <br />2002. She noted that based on Ponderosa's marketing studies, there is a <br />tremendous demand for this type of senior housing, as evidenced by many <br />seniors desirous of having a senior single-story detached home at the <br />square-foot ranges being proposed, with a patio or a patio-size yard and a <br />low-maintenance front yard to be maintained by the Homeowners Association. <br />She noted that they are proposing a very green project which exceeds the <br />minimum requirements. She noted that Jeff Schroeder of Ponderosa Homes and <br />Mark Sweeney, one of the owners of the Gardens at Ironwood Senior <br />Apartments located within the Ironwood development, are in the audience. She <br />thanked staff for their excellent overview and stated that Ponderosa is in <br />agreement with staff's analysis and recommendations. She provided a <br />background of when Ponderosa first began its work on the project with the City, <br />noting that they jointly hosted a series of community meetings which were very <br />PLANNING COMMISSION MINUTES, July 9, 2008 Page 15 of 39 <br />
