<br /> <br />(a) Declarant has appointed the Architectural <br />Committee comprised of , , <br />an w o are <br />oea e a a n ree , eaehnton, orn a. The <br />Committee nay designate a representative to act for it. In case <br />o! death or resignation of any member of the Committee, the <br />remaining aenbers shall have full authority to designate a <br />successor. Neither the members of the Committee nor its <br />designated representative shall be entitled to any compensation <br />for services performed under this covenant. <br />(b) Declarant reserves the right to appoint all <br />replacements until the first anniversary of the sale of the first <br />lot within the Subdivision, end reserves to itself the power to <br />appoint a majority of the members of the Committee until ninety <br />percent (90R of all the subdivision interests in the overall <br />development have been sold or until the filth (5th) anniversary <br />of sale of the first lot within the subdivision, whichever first <br />occurs. <br />(c) After one (1) year from the date of the sale of <br />the first (let) lot within the subdivision, the majority of lot <br />owners shall have the power to appoint one (1) member to the <br />Architectural Control Committee until ninety percent (90t) of all <br />of the subdivision interests in the overall development have been <br />sold or until the fifth (5th) anniversary Aate of the axle of the <br />first (1st) lots within the subdivision, whichever first occurs. <br />Thereafter the majority of lot owners shall have the power to <br />appoint all of the members of the Architectural Committee. <br />(d) Members appointed to the Architectural Committee <br />by the lot owners within the subdivision shall be from the lot <br />owners within the subdivision. Members appointed to the <br />Committee by the subdivider need not be owners of lots within the <br />•ubdivision. <br />(e) The Committee's approval or disapproval as <br />required in these covenants shall he in writing. In the event <br />the Committee, or its designated representatives, fail to approve <br />or disapprove or otherwise fail to act within thirty (30) days <br />after plans and specifications or other matters have been <br />submitted to it, approval shall not he required and the related <br />covenant shall be deemed to have been fully coeplied with. <br />(f) Any action at law or in equity to enforce the <br />provisions of this Article IIi, Section 9, shall be commenced in <br />any court of competent jurisdiction,. prior to the completion of <br />any construction Mhich is not in compliance with this Section. <br />Section 2.
