JUVENILE DIVERSION PROGRAM <br /> <br />1. Juvenile offenders will be treated in a manner that will encourage <br /> positive changes in behavior. <br /> <br />2. The City of Pleasanton has established a Minor Offense Court for the <br /> treatment of youthful offenders referred to them by the police depart- <br /> ment. The purpose of Minor Offense Court is to provide an alternative <br /> to the juvenile justice system, whereby certain offenders may be <br /> counseled using local community-oriented resources. <br /> <br />3. The Minor Offense Court Board shall consist of members of the community <br /> who are named by the Police Chief and approved by the City Council. A <br /> sworn Pleasanton police officer shall also be present at each Minor <br /> Offense Court session. <br /> <br /> a Only two civilian members will be present at each session. <br /> <br /> b The police officer member will be responsible for the following: <br /> <br /> (1) Making introductions for each group <br /> (2) Maintaining order <br /> (3) Answering legal and procedural questions <br /> (4) Keeping hearings on schedule <br /> <br />4. Eligibility for diversion to the Minor Offense Court depends up the <br /> following requirements: <br /> <br /> (a) Juvenile offenders must live within the local school disctricts. <br /> <br /> (b) The offense shall not be of a serious nature. <br /> <br /> (c) The juvenile must be a first-time offender. <br /> <br /> (d) The juvenile must admit guilt and show remorse for the crime <br /> prior to the hearing. <br /> <br />5. Community service projects arranged before the hearing. Such <br /> projects may be assigned to the juvenile offender. Restitution, <br /> essays or other projects deemed appropriate by the Board may be <br /> assigned. <br /> <br />6. Upon successful completion of the MOC requirements the juvenile's <br /> case file shall be annotated. <br /> <br /> <br />
