CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-562 <br /> <br /> ACCEPTANCE OF COMMON AREA EASEMENTS WITHIN PARCEL MAP <br /> 4390 AND RESCINDING RESOLUTION 85-481 <br /> <br /> WHEREAS, at its meeting of October 15, 1985, the City Council <br /> adopted Resolution No. 85-481 accepting common area <br /> easements in Parcel Map 4390; and <br /> <br /> WHEREAS, due to a change of ownership and change in easements to <br /> be dedicated, it is necessary to rescind the prior <br /> resolution and accept a new deed; and <br /> <br /> WHEREAS, the City is in receipt of a Grant of Easement from <br /> Callahan-Pentz Properties, Pleasanton-Old Santa Rita <br /> Road to the City of Pleasanton, a copy of which is <br /> attached hereto and incorporated herein by this <br /> reference, for purposes of common area landscaping; and <br /> <br /> WHEREAS, at its meeting of December 3, 1985, the City Council <br /> received a report from the Director of Public Works and <br /> Utilities (SR 85:582) indicating that the acceptance of <br /> this deed is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Grant of Easement from Callahan Pentz Properties, <br /> Pleasanton-Old Santa Rita Road to the City of Pleasanton <br /> for common area landscaping is hereby accepted and the <br /> appropriate City officers are instructed to take <br /> whatever action necessary to implement said acceptance. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED DECEMBER 3, 1985 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Mercer, Mohr, Wood and Mayor <br /> Brandes <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTEST: , <br /> F BRA JR <br /> MAYOR <br /> <br /> s R.
