CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-560 <br /> <br /> RESOLUTION APPROVING LOW INCOME HOUSING EXEMPTION FROM <br /> THE GROWTH MANAGEMENT PROGRAM FOR CALLAHAN PENTZ <br /> PROPERTIES <br /> <br />WHEREAS, Callahan Pentz Properties has requested a lower income <br /> housing exemption under Section 2-20.04 of the Growth <br /> Management ordinance for 103 units of a 412 unit <br /> residential project located on the north side of Andrews <br /> Drive between West Las Positas Boulevard and Old Santa <br /> Rita Road; and <br /> <br />WHEREAS, currently the City has 100 units in the lower income set <br /> aside under the Growth Management Program and it is <br /> necessary to amend the set aside to increase it by three <br /> units; and <br /> <br />WHEREAS, the Director of Planning and Community Development <br /> presented his report (85:572) regarding the request from <br /> Callahan Pentz Properties which analyzed the request and <br /> made several recommendations; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The existing 1986 low income set aside units shall be <br /> amended to include three more units which shall be <br /> charged against the 1987 allocation. <br /> <br />Section 2: Approves the application for 103 units of low income <br /> set aside which would allow construction of the entire <br /> 412 unit complex for Callahan Pentz Properties. <br /> <br />Section 3: Directs the City Attorney to prepare an agreement <br /> which includes the following elements: <br /> <br /> a. That the 103 designated lower income units shall be <br /> subject to rent limitations for at least fifteen <br /> (15) years; <br /> <br /> · b. Rent adjustments may be allowed annually based upon <br /> HUD income guidelines; <br /> <br /> c. The developer and subsequent successors shall be <br /> responsible for yearly status reports on the <br /> administration of the lower income units within the <br /> project. Such reports will include information on <br /> occupancy and income of tenants; <br /> <br /> <br />
