CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-559 <br /> <br /> DENIAL OF THE APPEAL OF THE CITY COUNCIL OF A DECISION <br /> OF THE PLANNING COMMISSION APPROVING A CONDITIONAL USE <br /> PERMIT TO OPERATE A RELIGIOUS INSTITUTION AT 328 ST. <br /> MARY'S STREET <br /> <br />WHEREAS, at its meeting of October 23, 1985, the Planning <br /> Commission approved a conditional use permit to maintain <br /> a religious institution at 328 St. Mary's Street; and <br /> <br />WHEREAS, the City Council appealed this decision for further <br /> review; and <br /> <br />WHEREAS, a duly noticed public hearing was held before the City <br /> Council on November 19, 1985 wherein all pertinent <br /> testimony and documents were reviewed; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the City Council (AP-85-20) of <br /> the decision of the Planning Commission, and approves <br /> UP-85-29, the application of the Church of Divine Man <br /> for a conditional use permit to operate a religious <br /> institution at 328 St. Mary's Street, as conditioned by <br /> the Planning Commission, with all church uses restricted <br /> to the area not formerly leased to Cellar Liquors (i.e. <br /> second floor and kitchen on first floor) with the <br /> remainder of the first floor restricted to retail uses. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED NOVEMBER 19, 1985 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Mercer and Mohr <br />NOES: Councilmember Wood and Mayor Brandes <br /> <br />ABSTAIN: None <br /> <br />ATTEST: <br /> F B N Es JR <br /> · , .
