CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-528 <br /> <br /> RESOLUTION AUTHORIZING CITY COUNCILMEMBERS' ENROLLMENT <br /> IN THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM (PERS) AS <br /> OPTIONAL MEMBERS <br /> <br />WHEREAS, Section 20361 of the Public Employees' Retirement law <br /> provides that an elective officer may become a member of <br /> PERS as an "Optional Member" upon the filing with the <br /> Board of Administration of PERS an election in writing <br /> to become a member; and <br /> <br />WHEREAS, Section 36516(d) of the Government Code provides that <br /> retirement benefits for City Councilmembers shall not be <br /> considered salary if said benefits are provided all city <br /> employees; and <br /> <br />WHEREAS, all eligible city employees are members of PERS, with <br /> their membership contribution paid by the City; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Individual members of the City Council may elect to <br /> become optional members of the PERS. <br /> <br />Section 2: For said City Councilmembers the City shall pay <br /> prospectively the employee's 7% membership contribution. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED NOVEMBER 5, 1985 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wood and Mayor <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTEST: <br /> ....
