O. Box 520 <br /> Pleasanton, California 94566 <br /> <br /> Notice by certified mail shall be deemed to be <br />communicated twenty-four (24) hours from the time of mailing. <br /> <br /> 26. This Lease is, and shall be, binding upon the heirs <br />and executors, administrators, successors and assigns and respective <br />parties hereto. <br /> <br /> 27. Lessee shall be liable for the payment of any <br />possessory interest tax levied against the leased premises together <br />with any and all trade fixtures or other property placed by Lessee <br />in or on or about the demised premises. <br /> <br /> 28. It is agreed by and between the parties hereto that <br />time is of the essence in this Lease and failure of Lessee to <br />perform as provided herein shall be cause for the termination of the <br />Lease. <br /> <br /> 29. Any disputes arising under this agreement between <br />Lessor and Lessee shall be resolved by Secretary-Manager of Lessor <br />and City Manager of Lessee if possible. If a dispute cannot be <br />resolved in said manner, it shall be submitted for arbitration to <br />the Fair Liaison Committee consisting of two representatives of <br />Lessor's Board and two representatives of Lessee's City Council. <br /> <br /> 30. Wholly aside from all other provisions of this <br />agreement, City agrees to lease and the Alameda County Agricultural <br />Fair Association (hereinafter "Fair Association") agrees to rent a <br />0.435 acre parcel of land shown in Attachment B to this Agreement <br />("Lease Parcel"). The term of this lease shall be for the period <br />from the date of this agreement to August 1, 1987. The Fair <br />Association shall pay the City Two Dollars ($2.00) as rent for said <br />lease. The Fair Association shall defend, hold harmless and <br />indemnify the City for any liability claims which arise in relation <br />to the Lease Parcel. <br /> <br /> - 6 - <br /> <br /> <br />
