9. In accordance with the Class C rates of Schedule LS-1, or such other schedules as may hereafter be applicable for service to such a street lighting system, City shall be responsible for the monthly service charge for all Street Lighting Service Facilities installed hereunder. 10. This agreement does not provide for the installation by PGandE of any underground conduits and/or conductors extending from the Electric Facilities to any existing or proposed building within the District other than as provided in the attached plans and specifications. The obligations of both the property owners and PGand~ under PGandE's Electric Extension and Service Rules on file with th Calif~rni.a Public Utilities Commission (Commission), relating to extension and service installations, are not included in this agreement. 11. Any rearrangement, relocation, addition to or modification of the Electric Facilities, Electric Relocation Facilities and Street Lighting Service Facilities as shown on Exhibit "A" after commencement of construction required for' any reason other than the sole convenience of PGandE shall be paid for on demand and in advance by City. 12. City shall, upon the installation of'the Electric Facilities, Electric Relocation Facilities and Street Lighting Service Facilities, execute and deliver to PGandE a deed or deeds in the form attached hereto as Exhibit "B" conveying the Electric Facilities, Electric Retocation Facilities and a portion of the Street Lighs~ng Service Facilities to PGandE. 13. Except as provied in paragraph 9, City shall make payments to PGandE hereur~der only from the proceeds of asessments l~vied and bonds sold in the assessment district proceedings.. There shall be no liability upon City to make such payment from any other source of funds. PGandE shall not be obligated to proceed hereunder until sufficient funds have been made available and all payments to be made to PGandE have been made. -4-
