MEMORANDUM OF UNDERSTANDING <br /> <br /> PROPOSED VALLEY AVENUE CROSSING OF <br /> WESTERN PACIFIC AND SOUTHERN PACIFIC <br /> RAILROADS IN THE CITY OF PLEASANTON <br /> <br /> This document sets forth the understandings and the <br />commitments with respect to the City of Pleasanton's plan to <br />construct new crossings across the rights-of-way and facilities <br />of the Western Pacific Railroad Company (WPRR) (now owned by <br />Union Pacific Railroad Company) and the Southern Pacific <br />Transportation Company (SPTCo), at or near WP MP 42.77, SP MP <br />D-42.08, SP MP BO-67.63 and SP MP BO-67.32, in said City. WPRR <br />and SPTCo are sometimes collectively referred to herein as <br />"railroads". <br /> <br /> 1. Existing Proceeding. City has previously filed its <br />Application No. 83-12-29 with the California Public Utilities <br />Commission ("PUC"), requesting authority to construct public <br />crossings at-grade at approximately the following locations: <br /> <br /> SPTCo and WPRR mainlines, MP D-42.08 and 4-42.77, <br /> respectively <br /> <br /> SPTCo Radum Branch BO-67.63 <br /> <br /> SPTCo Radum Branch BO-67.32 (Busch Road) <br /> <br />On August 7, 1985, the Commission granted the City application as <br />amended and subject to terms as set forth in its Decision <br />85-08-037. SPTCo has filed an application for rehearing of the <br />decision. <br /> <br /> 2. Application for Underpass. <br /> <br /> a. The City shall submit an Application to Modify PUC <br /> Decision 85-08-037. The Application to Modify shall request <br /> authority to construct an underpass structure instead of the <br /> approved at-grade crossing at crossing No. 4-42.77 (WPRR <br /> mainline and SPTCo tail track). <br /> <br /> b. The Application to Modify shall request that any <br /> references, findings and orders in the Decision 85-08-037 <br /> concerning stubbing of the SPTCo tail track be superseded and <br /> annulled. <br /> <br /> c. The application to modify shall request authority <br /> to construct an underpass structure which shall be designed <br /> to accommodate the existing single mainline WPRR track and <br /> the SPTCo tail track spaced not farther than 16 feet <br /> centerline to centerline, utilizing a reinforced concrete <br /> type of design substantially similar to the proposed Bernal <br /> Avenue Underpass, PUC No. 4-41.1B (with modifications <br /> <br /> - 1 - <br /> <br /> <br />
