VALLEY AVENUE EXTENSION AGREEMENT (MADDEN) <br /> <br /> THIS AGREEMENT is entered into this 7th day of January, 1985, <br /> by and between the CITY OF PLEASANTON, a municipal corporation, <br /> (hereinafter referred to as "City") and JOSEPH MADDEN <br /> <br /> (hereinafter referred to as "Landowner"). <br /> RECITALS ~ <br /> A. Landowner owns two parcels of land totaling 13.64 acres <br />between the Southern Pacific Right of Way and the Western Pacific <br />Right of Way adjacent to Stanley Boulevard in the vicinity of the <br />proposed Valley Avenue extension (APN 946-1250-29 consisting of <br />5.99 acres and APN 946-1686-1 consisting of 7.645 acres). <br /> <br />B. City has applied to the California Public Utilities <br />Commission for approval of the Valley Avenue Extension Project <br />(P.U.C. Application No. 83-12-39). <br /> <br /> C. The Valley Avenue Extension Project consists of three <br />public street crossings of the existing railroad tracks including <br />the extension of Valley Avenue to connect with Stanley Boulevard, <br />and upgrading the Busch Road connection to Valley Avenue to <br />become a public rather than private crossing (see Exhibit A, <br />attached). In the alternative, the Valley Avenue Extension <br />Project may be modified to provide a grade separation for the <br />Western Pacific Main Line and the Southern Pacific tail track <br />(with the Southern Pacific tail track to be relocated to the <br />Western Pacific right of way adjacent to the Property.) <br /> <br /> D. The Property is within the area which will specially <br />benefit from the proposed Valley Avenue Extension Project. <br /> <br /> - 1 - <br /> <br /> <br />
