CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-505 <br /> <br /> RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING WITH <br /> SOUTHERN PACIFIC TRANSPORTATION COMPANY AND WESTERN <br /> PACIFIC RAILROAD COMPANY PROVIDING FOR CONSTRUCTION OF <br /> GRADE SEPARATIONS AT VALLEY AVENUE AND STANLEY BOULEVARD <br /> <br />WHEREAS, the City of Pleasanton has been working with the <br /> railroads since the early 1980's to arrange for the <br /> Valley Avenue extension; and <br /> <br />WHEREAS, the Public Utilities Commission approved the City's <br /> application for an at-grade crossing on August 7, 1985; <br /> and <br /> <br />WHEREAS, in conjunction with the above Valley Avenue extension, a <br /> land trade has been negotiated between Southern Pacific <br /> and the adjacent landowner, Joseph E. Madden. Mr. <br /> Madden has pledged his cooperation to the City and the <br /> railroads for the Valley Avenue extension and <br /> construction of the necessary railroad improvements; and <br /> <br />WHEREAS, Mr. Madden has, by letter, indicated the acceptability <br /> of the property trade as required in the draft <br /> Cooperation Agreement between the City and Mr. Madden; <br /> and <br /> <br />WHEREAS, at its meeting of October 15, 1985, the City Council <br /> reviewed the report of the City Attorney (SR 85:506) <br /> regarding the proposed agreements and construction; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council approves the Cooperation Agreement <br /> between the City of Pleasanton and Joseph E. Madden, a <br /> copy of which is attached hereto and incorporated herein <br /> by this reference. <br /> <br />Section 2: The City Council approves the Memorandum of <br /> Understanding between the City of Pleasanton, Southern <br /> Pacific Transportation Company and Western Pacific <br /> Railroad Company providing for a grade separation and <br /> two at-grade crossings, a copy of which is attached <br /> hereto and incorporated herein by this reference, <br /> provided, however, this approval is made conditional <br /> upon receipt of a copy of the Memorandum of <br /> Understanding executed by both railroads. <br /> <br /> <br />
