REIMBURSEMENT AGREEMENT FOR <br /> MOHR-MARTIN SEWER OVERSIZING <br /> <br /> THIS AGREEMENT entered at Pleasanton, California, this <br /> day of , 1985, by and between the CITY OF <br /> PLEASANTON, a general law city, located in Alameda County, <br /> California (hereinafter called "City") and DAVIDSON, KAVANAGH & <br /> BREZZO DEVELOPMENT CO.; S}~ELTER CAPITAL; 8ID CORRIE; REEVES L. <br /> SHAW, TRUSTEE FOR NORMAN H. GENTRY, TANIA V. GENTRY, AND MARK T. <br /> GENTRY and SHEA HOMES (hereinafter called "Developers") is <br /> subject to the following conditions: <br /> <br /> WITNESSETH <br /> <br /> WHEREAS, Developers are the owners of real property in the <br /> City of Pleasanton, County of Alameda, State of California,as <br /> shown on Exhibit "A", attached hereto and fully incorporated by <br /> reference herein; and <br /> <br /> WHEREAS, Developers have caused or will cause to be <br /> constructed a sewer main extension to the benefit of said and <br /> other properties as shown on Exhibit "A"; the work included in <br /> the oversizing is as follows: <br /> <br /> a. Installation of a 12" sanitary sewer line on Santa Rita <br /> Road between Stoneridge Drive and the point of <br /> connection north of Arroyo Mocho Bridge. See Exhibit <br /> "D" for oversizing cost. <br /> <br /> b. Installation of a 12" sanitary sewer line on Stoneridge <br /> Drive between Santa Rita Road and Oakland Avenue. See <br /> Exhibit "B" for the oversizing cost; and <br /> <br /> WHEREAS, pursuant to the Map Act, Developers are entitled to <br />reimbursement for certain oversizing costs of said sewer main <br />extensions; and <br /> <br /> WHEREAS, City has inspected and accepted or will inspect and <br />accept said facilities. <br /> <br /> NOW, THEREFORE, it is agreed as follows: <br /> <br /> 1. Ownership~J~__Cj~tx. Upon completion and acceptance of <br />the work, ownership of said work shall vest in the City, with <br />Developers having the right to connect or the right to use said <br />improvements, and the right to reimbursement as provided below. <br /> <br /> 2. Mutual Benefit District. City and Developers hereby <br />establish a mutual benefit district to reimburse Developers for <br />the cost of any portion of said improvements benefiting land of <br />others. <br /> <br /> - 1 - <br /> <br /> <br />
