CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-482 <br /> <br /> RESOLUTION APPROVING THE ADJUSTMENTS TO COMMON AREA <br /> EASEMENTS WITHIN LOTS 1C AND 13A, HACIENDA BUSINESS <br /> PARK, AND ACCEPTING PARCELS OF NEW COMMON AREA EASEMENT <br /> AND VACATING PORTIONS OF EXISTING COMMON AREA EASEMENT <br /> <br />WHEREAS, on October 15, 1985, the City Council received a staff <br /> report recommending acceptance of portions of Common <br /> Area Easement more particularly described in Exhibit A, <br /> attached hereto and incorporated herein by this <br /> reference; and <br /> <br />WHEREAS, said staff report recommended the vacation of portions <br /> of Common Area Easement superseded by relocation, more <br /> particularly described in Exhibits B and C, attached <br /> hereto and incorporated herein by this reference; and <br /> <br />WHEREAS, the proposed adjustments to the Common Area Easements is <br /> consistent with the goals and policies of the General <br /> Plan; and <br /> <br />WHEREAS, the superseded portions of Common Area Easement are no <br /> longer necessary for present or prospective public use; <br /> and <br /> <br />WHEREAS, there is in place public utility facilities which are in <br /> use, and public convenience and necessity require the <br /> reservation of easements for these utility facilities; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City of Pleasanton hereby accepts the new Common <br /> Area dedications of easement within Lot 1D of Parcel Map <br /> 4392 from Prudential Insurance Company, as described in <br /> Exhibit A, and the appropriate city officers are <br /> instructed to take whatever action is necessary to <br /> implement said acceptance. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> relocation of the common area in a manner meeting the <br /> requirements of Section 8333(c) of the Streets and <br /> Highways Code, those portions of the Common Area <br /> Easement within Lot 1C, PM 4392, and Lot 13A, PM 4617, <br /> are hereby vacated and those portions of said Common <br /> Area Easement are hereby reserved as public service <br /> easement as shown in the attached Exhibit B and Exhibit <br /> C, respectively. <br /> <br /> <br />
