CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-471 <br /> <br /> DENYING THE APPEAL OF THE CITY OF PLEASANTON OF A <br /> DECISION OF THE ZONING ADMINISTRATOR AND APPROVING THE <br /> APPLICATION OF JERRY LOVING AND ASSOCIATES TO ELIMINATE <br /> CONDITION 3 OF PUD-81-20-1M <br /> <br />WHEREAS, Jerry Loving and Associates applied for a minor <br /> modification to remove a condition requiring all 32 <br /> units of Sunrise Villa (PUD-81-20) to be rented for five <br /> years, until September 1, 1988; and <br /> <br />WHEREAS, the Zoning Administrator approved the elimination of <br /> condition 3 of Resolution No. 83-160 (PUD-81-20-1M); and <br /> <br />WHEREAS, the City Council appealed the decision in order to <br /> review the application totally; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> October 1, 1985 at which time all pertinent testimony <br /> and documents were reviewed; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of the City Council and approves <br /> the application of Jerry Loving and Associates to <br /> eliminate the requirement that all 32 units be rented <br /> until September 1, 1988, subject to the following <br /> conditions: <br /> <br /> 1. That Condition No. 3 of PUD-81-20-1M shall be <br /> deleted, with all remaining conditions of PUD-81-20 <br /> and PUD-81-20-1M remaining in full force and <br /> effect. <br /> <br /> 2. That all tenant provisions of condominium <br /> conversion ordinance shall be applicable to the <br /> project and that notice to this effect shall be <br /> given to all existing tenants within two weeks of <br /> this approval. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
