Councilmember Sullivan felt it was prudent to understand what would occur if the business <br />closed and the City could not afford to operate it. City Manager Fialho said in the case of the <br />Ridgeview Commons Facility, the City required a pro forma and annual financial statements. He <br />said there is a formula with that plan that allows the City to share in the revenue and felt this <br />could also be applied to this project. <br />Councilmember McGovern said she has received calls regarding whether the City is benefitting <br />from this with a $1 lease, and asked staff to give the community a financial prospective that <br />looks at the benefits to the City over time, and Mr. Bocian agreed this could be included. <br />Councilmember McGovern said she read the EIR and referred to the section that talks about <br />recycled water; currently DSRSD owns and maintains recycled water for pipelines within the <br />vicinity of the proposed project area along EI Charro Road and that the pipelines were originally <br />part of the Clean Water Revival Project. But, if we came up with a recycled water service <br />assessment and there was adequate capacity, the City may be able to reach some agreement <br />for recycled water. She confirmed with the City Manager that this could be reviewed separately <br />when the entire project comes forward and he agreed to put it on the next agenda. <br />Mayor Hosterman opened the item to public comment. <br />Nick Powers said he was glad the Council is working on the rink, as well as other kids and <br />thanked the Council for their work on the Staples Ranch plan. <br />Guy Houston, State Assemblymember, said this is the project he wanted in Dublin before <br />leaving his Council office, and spoke in support of the Shark's proposal for the Staples Ranch <br />property. <br />Kurt Kummer confirmed with Mr. Bocian that the Sharks will be spending approximately $7 <br />million and urged the Council to approve the action tonight and move forward, citing all of the <br />recreation benefits. <br />Steve Brozosky said he's been in favor of the Sharks idea, however, asked to be more specific <br />in the ground lease the City is getting in exchange for the free land. He asked for a commitment <br />for a downtown outdoor rink, contributions for Bernal Park, for the minimum number of free <br />hours the community will receive in exchange, and asked that an official deal be made with <br />Hendricks before signing a ground lease. <br />Councilmember Sullivan questioned staff on the effective date of the lease, and City Manager <br />Fialho said staff would like the Council to at least approve a draft ground lease within a 90-day <br />period, but not execute it. The agreement would be attached to the PUD application later. Staff <br />believes Hendricks Automotive will come in with their PUD application first, followed by CLC, <br />then Fremont Land, and then Sharks at the end. At this point, the Council would take action also <br />on the associated development agreements and also authorize and execute the ground lease <br />on the Sharks facility. <br />Vice Mayor Thorne suggested that until all of the PUD's are done and the City has an <br />agreement with the County to annex it, the ground lease not be finalized. <br />Debbie Look spoke in favor of the Sharks facility moving forward as a parent and PTA <br />volunteer, said it provides an opportunity for a lifelong recreational skill, and as campaign <br />director for the Pleasanton Cultural Arts Foundation, she has held discussions with the Sharks <br />about making a contribution to the Firehouse Arts Center as part of their contribution to the <br />community and urged the Council to move forward. <br />City Council Minutes 6 September 2, 2008 <br />
