ARTICLE 10 <br /> OTHER CONDITIONS OR SERVICE <br /> <br />(Describe any seNices not included above which are to be performed by the Architect or Owner. State whether ser- <br />vices to be provided by the Architect are Basic SeNices or Additional Se~ices.) <br /> <br /> 10.1 Landscape Architecture Included. Basic Services shall include Landscape <br /> Architecture in addition to Engineering, as outlined in Article l. <br /> <br /> 10.2 Services Not Included. Basic Services shall not include off-site Civil <br /> Engineering, Environmental Impact Studies or Reports, Geotechnical Investi- <br /> gations, Acoustical Testing or Reports, Special Energy Studies or Computer <br /> Runs, Surveys or Parcel Maps, or reproduction costs. <br /> <br /> 10.3 Payments. Billings shall be submitted monthly and shall be due thirty (30) <br /> da~vs after date of invoice. Billings shall be submitted to the City <br /> Manager with copy submitted contemporaneously to Eden Housing, Inc. <br /> (Attention: Tim Truesdale) of Hayward. Each billing shall itemize the <br /> number of hours by job category as set forth on Exhibit A attached. Each <br /> billing shall include a cumulative total for billings on this project. <br /> <br /> 10.4 Personnel Expense. Direct Personnel Expense is defined as the direct <br /> salaries of all the Architect's personnel engaged on the Project, and the <br /> portion of the cost of their mandatory and customary contributions and <br /> benefits related thereto, such as employment taxes and other statutory <br /> benefits, insurance, sick leave, holidays, vacations, pensions and similar <br /> contributions and benefits. The current schedules of personnel salaries is <br /> attached as Exhibit A. <br /> <br /> 10.5 Cost Estimates. Notwithstanding Section 2.6, Architect will provide or <br /> obtain cost estimates as necessary to develop a financing plan and as <br /> necessary for the bidding process. City understands that changing <br /> circumstances often render cost estimates inaccurate and agrees that <br /> Architect shall be held harmless from liability based upon deviation be- <br /> tween actual costs and cost estimates. <br /> <br /> 10.6 Principal In Charge. Robert Tucker shall be and remain as the principal <br /> in charge of work and shall not be replaced or removed from that role <br /> without the consent of the City Manager. <br /> <br /> 10.7 Insurance. Architect will provide a certificate of insurance indicating <br /> current insurance coverage within ten (10) days of City approval of this <br /> Agreement and shall not reduce its insurance coverage below the levels <br /> specified in the~C~tificate"of insurance without ten (10) days advance <br /> notice to the City Manager.
