CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-413 <br /> <br /> ACCEPTANCE OF GRANT DEED FROM WESTERN PACIFIC RAILROAD <br /> COMPANY FOR CONSTRUCTION OF BERNAL AVENUE UNDERPASS AND <br /> APPROVAL OF REAL PROPERTY PURCHASE CONTRACT <br /> <br />WHEREAS, the County of Alameda Right-of-Way Department has <br /> acquired on behalf of the City of Pleasanton property <br /> from the Western Pacific Railroad (one of several <br /> parcels needed for the new Bernal Avenue underpass at <br /> the Western Pacific Railroad); and <br /> <br />WHEREAS, the City is in receipt of a Grant Deed from Western <br /> Pacific Railroad Company to the City of Pleasanton, a <br /> copy of which is attached hereto and incorporated herein <br /> by this reference, for purposes of construction of the <br /> Bernal Avenue underpass; and <br /> <br />WHEREAS, at its meeting of September 3, 1985, the City Council <br /> received a report from the Acting Director of Public <br /> Works and Utilities indicating that the acceptance of <br /> this deed and approval of the Real Property Purchase <br /> Contract is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Grant Deed from Western Pacific Railroad Company <br /> to the City of Pleasanton for construction of the Bernal <br /> Avenue Underpass is hereby accepted and the appropriate <br /> City officers are instructed to take whatever action <br /> necessary to implement said acceptance. <br /> <br />Section 2: Approves the Real Property Purchase Contract between <br /> the City of Pleasanton and the Western Pacific Railroad <br /> Company, a copy of which is attached hereto and <br /> incorporated herein by this reference. <br /> <br />Section 3: Authorizes the Acting Director of Public Works and <br />Utilities to execute the Real Property Purchase Contract. <br /> <br />Section 4: Authorizes staff to deposit $89,250.00 into escrow <br /> for the purchase of said property. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
