CONTRACT <br />MARILYN MURPHY KANE TRAIL <br />PROJECT NO. 087032 <br />ATTACHMENT4 <br />THIS CONTRACT is made and entered into this 21st day of October, 2008 by and <br />between McGUIRE and HESTER ("Contractor"), whose address is 9009 Railroad Avenue, <br />Oakland, CA 94603, with telephone number (510) 632-7676, and the CITY OF PLEASANTON, <br />a municipal corporation ("City"). <br />WITNESSETH: <br />WHEREAS, the City has awazded to the Contractor a contract for Mazilyn Murphy Kane <br />Trail Project # 087032. <br />NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties <br />agree as follows: <br />Work to be Performed. <br />The work, in general, consists ofconstructing amulti-purpose trail along the east side of <br />Arroyo de la Laguna between Bernal Avenue and the northern limit of Castlewood <br />Country Club including three vista points and other related appurtenances. <br />Said work is more particulazly shown in the following documents which aze on file with <br />the Department of Community Development of the City and aze incorporated herein by <br />this reference: <br />A. Plans and Specifications entitled the Marilyn Murphy Kane Trail Project # <br />087032 and addenda thereto, if any. <br />B. Contract Change Orders approved by the City Engineer, done in <br />accordance with the Standard Specifications. <br />C. The elements of the proposal submitted to the City by the Contractor, <br />which the City has accepted. <br />2. Compensation. The City shall pay the Contractor for work actually performed at the unit <br />prices set out in the Contractor's proposal to the City. The quantities of work stated <br />therein aze estimates only; actual quantities will be measured for payment in accordance <br />with the specifications. <br />
