EXHIBIT B <br />CONDITIONS OF APPROVAL <br />Case PUD-62, Windstar Communities, Inc. <br />6110 Stoneridge Mall Road <br />September 16, 2008 <br />General Conditions <br />1. Development shall be substantially as shown on the development plans, <br />color/material board, Multifamily GreenPoint Checklist, and related materials <br />such as the noise analysis, Exhibit A, dated "Received" September 20, 2007, on <br />file with the Planning Division, except as modified by the following conditions. <br />Minor changes to the plans may be allowed subject to the approval of the <br />Director of Planning and Community Development if found to be in substantial <br />conformance to the approved exhibits. <br />2. The subject property is zoned Planned Unit Development -High Density <br />Residential/Commercial (PUD-HDR/C) District. The permitted uses on the <br />subject property shall include multi-family residential, leasing office for the <br />complex, City of Pleasanton/BART Police office, and, for the retail space and <br />kiosk designated on the development plan, the uses indicated in the attached <br />Exhibit C. <br />3. The PUD development plan approval shall lapse two years from the effective <br />date of this ordinance unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion. <br />4. All conditions of approval shall be attached to all building permit plan check sets <br />submitted for review and approval, whether stapled to the plans or located on a <br />separate plan sheet. These conditions of approval shall be attached at all times <br />to any grading and construction plans kept on the project site. It is the <br />responsibility of the applicant to ensure that the project contractor is aware of, <br />and abides by, all conditions of approval. It is the responsibility of the applicant <br />to ensure that the project landscape contractor is aware of, and adheres to, the <br />approved landscape and irrigation plans, and all conditions of approval. Prior <br />approval from the Planning Division is required before any changes are <br />constituted in site design, grading, house design, house colors or materials, <br />green building measures, landscape material, etc. <br />5. The project shall comply with the City's Growth Management Ordinance. Prior to <br />issuance of a building permit, the applicant shall obtain all necessary growth <br />management approvals. <br />1 <br />
