CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-369 <br /> <br /> AUTHORIZATION OF CITY MANAGER TO NEGOTIATE AND EXECUTE A <br /> RIGHT-TO-ENTER AND CONSTRUCT TAWNY-BERNAL PARK (T) <br /> <br />WHEREAS, Ken Earp Investments has accepted bids and is ready to <br /> begin construction on the Tawny-Bernal Park (T); and <br /> <br />WHEREAS, although the Tawny-Bernal Park (T) has been designated <br /> as a City park, the site is still privately owned; and <br /> <br />WHEREAS, in order for Ken Earp Investments to proceed with the <br /> work on the park prior to dedication of the land to the <br /> City, a right-to-enter must be granted by McBail <br /> Company, the property owner; and <br /> <br />WHEREAS, at its meeting of August 6, 1985, the City Council <br /> received a report from the Director of Public Works and <br /> Utilities asking authority for the City Manager to <br /> negotiate and enter into a right-to-enter; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Directs the City Manager to negotiate and sign a <br /> right-to-enter to construct the Tawny-Bernal Park (T). <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED AUGUST 6, 1985 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mohr, and Wood <br />NOES: None <br />ABSENT: Councilmember Butler and Mayor Merc r / <br /> <br />ABSTAIN: None .~l'l ~~ <br /> F NK cDES, JR <br /> VICE MAYOR <br /> <br />By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />Brian W.
