Discussion ensued between the Commission and staff relating to the size of lot and pad, enforcement of <br />construction timelines, completion of geotechnical evaluations, the color of the house, and current <br />grading that is being done on the property. Commissioner Sullivan commented on possible grading <br />being done on this property and inquired about dirt that is placed at the base of trees. <br />Commissioner Maas suggested continuing this hearing until a new geotechnical survey could be <br />conducted and concerns related to grading aze resolved. <br />PUBLIC HEARING WAS OPENED <br />Jerrell Thomas, the applicant, addressed the geotechnical concerns and stated that a subsequent <br />geotechnical study had been performed and another geotechnical study would be performed when the lot <br />is approved to be built. Some repair work is needed. He stated that no grading has been conducted on <br />the property since he has owned the property. He stated that an adjacent builder requested the temporary <br />dumping of dirt on this property until such time the dirt could be hauled away. The applicant stated he <br />would take full responsibility for removal of the dirt from around the trees on the property. <br />The applicant further urged the Commission not to view this property as a new lot and informed the <br />Commission of the monies that have been spent and the improvements that have been performed on the <br />property. He requested that the Commission approve the set-back of the lot from the fire turn around, <br />due to his private agreement with the Nelsons relating to maintenance of the fire road. He stated that the <br />delay were due to his not being an experienced developer and because there were very complicated <br />issues with the neighbors. <br />_ Further, he requested that the property not be subject to growth management constraints, that property <br />not be subject to a two-year expiration date for building, that the property not be subject to restrictions <br />on design guidelines, and that the Commission reimburse the applicant's $2,000 application fee or <br />provide credit to him. <br />Vicki Thomas, 27933 Via Ventana, Los Altos Hills, stated that as applicants they have cooperated fully <br />in meeting requirements of the City of Pleasanton and the neighbors. Further, she stated that a <br />considerable amount of monies have been expended in connection with this property. She requested that <br />the Commission approve this application. <br />(Recess taken from 9:42 - 9:50 p.m.) <br />Neil Nelson, 8088 Bethel Lane, commended the applicants for their perseverance in pursuing this project <br />and expressed support with the applicant's efforts. Mr. Nelson referenced a letter dated September 21, <br />1998, and requested that the Commission return the slope of property to the original contours on the <br />Whitaker's side or provide a grading permit documentation approved by a public process that would <br />lead to the approval of the existing PUD site contours; include as part of the conditions of approval that <br />the fire turn-azound and slope on Pazcel "B" be corrected to provide a flat pavement area and a slope of <br />3:1 until the slope meets original native soil; include an indication that this PUD bear the responsibility <br />to maintain the fire turn-azound substructure/pavement areas including those portions on the adjacent <br />PLANNING COMMISSION MINUTES Page 7 October 14, 1998 <br />
