_ the fund would be used exclusively for acquiring, developing, and maintaining pazking facilities in this <br />specific azea of benefit. Staff recommended that the azea of benefit on the east side of Main Street be <br />extended to First Street as has been done in other cases. <br />With respect to parking, Mr. Iserson stated that the number of parking spaces is based on the <br />requirement of one pazking space for every three seats for the restaurant azea on the first-floor, and one <br />parking space for every 300 squaze feet for the proposed retail and office space. The 56 restaurant seats <br />and 617 squaze feet on the first floor would, therefore, require 21 parking spaces, and the 3,175 square <br />feet on the second floor would require 11 pazking spaces, for a total of 32 parking spaces. The applicant <br />is providing 20 spaces on site, resulting in a short-fall of 12 parking spaces which will be addressed in <br />the in-lieu pazking agreement. <br />Mr. Iserson added that the applicant would need to clarify the use of an azea in one of the turrets which <br />shows a stairway but which the applicant has recently indicated he plans to use as a storage area. He <br />also mentioned that staff had received a telephone call from Mr. Kim, owner of Pleasanton Liquor and <br />Deli, adjacent business at 728 Main Street, indicating that while he is not opposed to the project, he <br />wants to ensure that there is sufficient pazking available. <br />In conclusion, Mr. Iserson stated that design review projects aze subject to Planning Commission <br />approval and in-lieu parking agreements to City Council approval. However, since both matters are <br />closely interrelated in this case and the applicant needs both approvals to conclude construction on the <br />project, both issues aze being presented to the Planning Commission for recommendation to the City <br />Council. He added that staff recommends that the Commission recommend to the Council approval of <br />the design review and the in-lieu pazking fee as conditioned in Exhibit B of the staff report. <br />Commissioner Roberts asked when the public pazking lot will be constructed in the azea. Mr. Iserson <br />replied that the City does not have a specific timetable at this time to implement its construction. He <br />added that Commissioner Dove is currently working with the Pleasanton Downtown Association on the <br />matter. <br />Chair Cooper inquired if the applicant would be exempt from paying the in-lieu fee if the public pazking <br />facility were built outside the area of benefit. Mr. Iserson said yes. He explained that there is a pazking <br />shortage in that end of the Downtown and that the City would like to extend the azea of benefit east to <br />First Street to take advantage of a chance to build a pazking lot on First Street. <br />Chair Cooper further asked if deferred payment is the standard procedure followed by other businesses. <br />Mr. Iserson said yes. He added that the calculation of in-lieu fees is based on the value of the property at <br />the time the fee is collected. If property values continue to escalate, deferred fees would be higher upon <br />payment; in the same way, fees collected by the City at this time would incur interest once invested. <br />Chair Cooper commented that there would be an exposure for the applicant in the sense that he would <br />know how much the fee would be if it were paid up-front as opposed to not knowing the exact amount in <br />the future. <br />Commissioner Maas inquired if any consideration was given to the actual availability of daytime <br />pazking spaces on Main Street when the computation of this project's pazking requirement was done. <br />Planning Commission Minutes Page 3 June 24, 1998 <br />
