A motion was made by Commissioner Wright, seconded by Commissioner Barker, recommending <br />that the Commission recommend approval of the draft Negative Declaration, making the PUD <br />development plan findings, and recommending approval of PUD-98-1, subject to the Conditions <br />identified in Exhibit "B", except deleting Condition No. 17, and adding a condition that a 25-foot <br />side yard setback be maintained. <br />ROLL CALL VOTE <br />AYES: Commissioners Bazker, Dove, Kumazan, and Wright, and Chair Cooper <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-98-20 was entered recommending approval of the draft Negative Declaration <br />for Case PUD-98-O1 as motioned. <br />Resolution No. PC-98-21 was entered and adopted recommending approval of Case PUD-98-O1, as <br />motioned. <br />e. PUD-90-19-7M, Bhulabhai & Vanita Patel <br />Application for a major modification to a planned unit development to increase the maximum <br />floor area of Lot 92 of the Moller Ranch development from 4,500 square feet to 4,956 square feet <br />and design review approval for the two-story 4,956 square foot home with a 1,560 square foot <br />garage located at 5568 Serenity Terrace. Zoning for the property is PUD-RuraULDR/A (Planned <br />Unit Development-RuraULow Density ResidentiaUAgriculture) District. <br />Mr. Iserson presented the application. He noted that the Moller Ranch PUD was approved in 1991 and <br />certain minor modifications have been approved. However, approximately one year ago, the developer <br />asked for major modification of the development standards for some of the lots along Foothill Road. <br />With the exception of a slight height increase, the City Council denied all other requested modifications. <br />One of the proposed modification which was denied was a request to increase the 4,500 squaze foot <br />maximum house size of the first tier lots. <br />Mr. Iserson noted that when the applicant first approached staff regazding plans for a home larger than <br />4,500 square feet, staff informed him of the City Council's recent decision. Staff also advised him that it <br />would be very difficult, if not impossible, for staff to support such a request. Subsequently, the <br />applicant filed a PUD major modification requesting approval to increase the proposed home beyond the <br />4,500 square foot requirement. However, staff continued to work with the applicant in an attempt to <br />minimize the design issues. <br />Mr. Iserson described the proposed house, noting that it includes a 1,570 square foot, five-caz gazage <br />which is not included in the size limit. While staff acknowledges that it is a minor increase, it cannot <br />support the applicant because the City Council has made it clear to limit the house size and because it <br />feels a change to that limit would be a undesired precedent to others in the area. <br />Mr. Iserson stated that the applicant feels the increased size is needed because of his extended family <br />living in the home.
