RESOLUTION NO. 85-349 <br /> <br /> RESOLUTION OVERRULING PROTESTS <br /> <br /> NORTH PLEASANTON IMPROVEMENT DISTRICT NO. 1982-4 <br /> <br />The City Council of the City of Pleasanton resolves: <br />On July 16, 1985, the City Council opened a public <br />hearing on the resolution of intention and the engineer's report <br />on the proposed improvement in North Pleasanton Improvement <br />District No. 1982-4,City of Pleasanton, Alameda County, <br />California. <br /> <br /> At or before the time set for hearing, certain <br /> <br />interested persons made protests or objections to the proposed <br />roadway improvement, the extent of the assessment district or the <br />proposed roadway assessment. <br /> <br /> Among those protesting, Kaiser Foundation Health Plan, <br />inc. asked to be exempted from the assessment district upon the <br />same basis as Valley Memorial Hospital property had been earlier <br />exempted; to wit: Kaiser Foundation Health Plan, Inc. is a <br />nonprofit hospital which serves a significant portion of the City <br />population and provides below market and/or free care to those <br />using Medicare, Medicaid, or the indigent. <br /> <br /> With respect to Kaiser's request for exemption, the <br />Council finds that there are significant differences in the <br />circumstances between Kaiser Foundation Health Plan and Valley <br />Memorial Hospital relating to the circumstances of the peculiar <br />properties themselves, the conditions of approval relating to the <br />proposed development, the sites, and benefit accruing to the <br />respective properties by the planned works of improvement. <br /> <br /> <br />
