CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-337 <br /> <br /> ACCEPTANCE OF CONSTRUCTION OF THE SOFTBALL FIELD ACCESS <br /> ROAD (PLEASANTON SCHOOL - BERNAL AVENUE), PROJECT NO. <br /> 84-21, AND APPROVAL OF FINAL PROGRESS PAYMENT TO WHALEN <br /> CONSTRUCTION <br /> <br />WHEREAS, work by Whalen Construction on the construction of the <br /> softball field access road (Pleasanton School - Bernal <br /> Avenue), Project No. 84-21, has been satisfactorily <br /> completed; and <br /> <br />WHEREAS, it is appropriate to authorize the final progress <br /> payment; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The work on the construction of the softball field <br /> access road (Pleasanton School - Bernal Avenue) is <br /> hereby accepted. <br /> <br />Section 2: Authorizes appropriation of an additional $11,978.83 <br /> for Change Order #1. <br /> <br />Section 3: The Director of Finance is instructed to prepare a <br /> warrant in the amount of $54,977.07 in favor of Whalen <br /> Construction in satisfaction of the final progress <br /> payment for the above-accepted work on Project No. <br /> 84-21. Ten percent (10%) of the total contract or <br /> $7,597.88 will be retained until thirty (30) days after <br /> filing of the Notice of Completion. <br /> <br />Section 4: The City Attorney is directed to file a Notice of <br /> Completion with the Alameda County Recorder. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 16, 1985 BY THE FOLLOWING VOTE: <br /> <br /> <br />
