the above-described facilities, both parties agreeing the <br />potential costs involved may significantly affect the ability <br />of VMH to deliver services to City and Valley residents, including <br />provision of service to indigents, at VMH's present hospital as <br />well as its ability to expand onto the Project Site. <br /> <br /> D. The City has found that the nature of a local <br />nonprofit hospital, as proposed by VMH, is essentially local- <br />serving rather than regional, and that the facilities to be <br />~onstructed would not receive special bonefit from the proposed <br />traffic circulation, water supply/distribution, and fire service <br />improvements; accordingly, the City has, or intends to, eliminate <br />the Project Site from assessment districts formed to construct <br />said improvements. <br /> <br /> E. If VMH sells the Project Site or does not construct <br />the said improvements within a reasonable time, the Project <br />Site, like other unimproved lands in the north Pleasanton area, <br />should bear its fair share of the costs of any assessment <br />districts formed to provide traffic circulation, water supply, <br />and fire service improvements to the north Pleasanton area. <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. Exemption of Project Site From Assessment Districts. <br />Except as provided for herein, the City agrees either (i) that <br />the Project Site shall not be included within north Pleasanton <br />assessment districts for traffic circulation, water supply/ <br />distribution, and fire services improvements, or (ii) if included <br />in such a district, that the Project Site shall receive a Zero <br />Dollar ($0.00) assessment. <br /> <br /> -2- <br /> <br /> <br />
