RESOLUTION N0.08-240 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING A GENERAL PLAN AMENDMENT FOR THE APPLICATION OF WINDSTAR COMMUNITIES, INC., AS FILED UNDER CASE PGPA-13 WHEREAS, at its meeting of September 16, 2008, the City Council received an application from Windstar Communities, Inc. for General Plan Amendment to change the General Plan Land Use Designation of the BART-owned property located at 6110 Stoneridge Mall Road, adjacent to the future West DubliNPleasanton BART station, to add "High Density Residential" to the existing "Retail/Highway/Service Commercial; Business and Professional Offices" designation; and WHEREAS, the Planning Commission held a public hearing on the proposed change and made recommendations to the City Council; and WHEREAS, based on the Initial Environmental Study, a Negative Declaration was adopted by the City Council on September 16, 2008; and WHEREAS, the City Council held a public hearing on September 16, 2008 with respect to the General Plan Amendment. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. The City Council approves the application of. Windstar Communities, Inc. for General Plan Amendment to change the General Plan Land Use Designation of the BART-owned property located at 6110 Stoneridge Mall Road, adjacent to the future West Dublin/Pleasanton BART station, to add "High Density Residential" to the existing "Retail/Highway/Service Commercial; Business and Professional Offices" designation, as shown on the attached Exhibit A, PGPA-13, General Plan Amendment Map, dated September 16, 2008, and incorporated herein by this reference. SECTION 2. The City determines that this is one of the four times in 2008 that the Land Use Element of the General Plan may be amended as provided in Government Code Section 65631. SECTION 3. This resolution shall become effective immediately upon its passage and adoption.
