EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PUD-72, Jerome and Laura Raney <br />4693 and 4715 Augustine Street <br />October 7, 2008 <br />General Conditions <br />The proposed development shall be in substantial conformance to the <br />development plan, Exhibit A, dated "Received, May 25, 2008," on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Director of <br />Planning and Community Development if found to be in substantial conformance <br />to the approved exhibits. <br />2. The PUD development plan shall be of no further validity and the project <br />developer shall be required to submit the same or new development plan for City <br />approval prior to development of the site in the event that the project developer <br />fails to record a final map within two (2) years of this PUD Development Plan <br />approval. <br />The project developer shall provide all buyers with copies of the project conditions <br />of approval. <br />4. The project developer shall work with the Pleasanton Unified School District and <br />the City Director of Planning and Community Development to develop a program, <br />in addition to the school impact fees required by State law and local ordinance, to <br />off-set this project's long-term effect on school facility needs in Pleasanton. This <br />program shall be designed to fund school facilities necessary to off-set this <br />project's reasonably related effect on the long-term need for expanded school <br />facilities to serve new development in Pleasanton. The method and manner for <br />the provision of these funds and/or facilities shall be approved by the City and in <br />place prior to issuance of building permit. In no event shall construction <br />commence unless the above method and manner for the provision of these funds <br />and/or facilities has been approved by the City. <br />5. All site improvements and home construction activities shall be limited to the <br />hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. In addition, no <br />construction shall be allowed on Saturday, Sunday, and Federal and State <br />Holidays. The Director of Planning and Community Development may approve <br />earlier "start times" or later "stop times" only for specific construction activities <br />(e.g., Concrete-foundation/floor pouring), if it can be demonstrated to the <br />satisfaction of the Director of Planning and Community Development that the <br />construction and construction traffic noise of the modified construction hours will <br />not affect nearby residents.
