4 <br />THE CITY OF <br />j~L£~S~4NTONe <br />CITY COUNCIL AGENDA REPORT <br />October 7, 2008 <br />Law Department <br />TITLE: APPROVE LEASE WITH METRO PCS FOR CELLULAR ANTENNA <br />FACILITIES ON CITY PROPERTY LOCATED ON SANTOS RANCH ROAD <br />WATER TANK SITE <br />SUMMARY <br />Metro PCS has requested to lease a portion of the City's Santos Ranch Road water <br />tank site. The company would install its facilities (a pole, antenna and supporting <br />infrastructure) on a small portion of the City's property in order to provide better cell <br />phone coverage for its customers in the Pleasanton and Tri-Valley area. City staff has <br />reviewed the area where the facilities would be installed and has determined that their <br />location on the water tank site will not interfere with the City's use of the site. Because, <br />however, the planning department is still reviewing the design of the facilities to <br />determine conformance with the City's telecommunications ordinance, the company will <br />still be required to obtain the necessary planning approvals from Pleasanton before <br />proceeding with installation of the facilities. The lease expressly provides that by <br />entering into the lease the City's discretionary land use authority concerning the <br />equipment/pole is not impaired. The monthly rent is $1,750 with an increase of 15% <br />every five years. The total term of the lease is 25 years. <br />RECOMMENDATION <br />Authorize the City Manager to execute a lease with Metro PCS for cellular antenna <br />facilities on City property. <br />FINANCIAL STATEMENT <br />Over a 25 year term, the lease will generate $707,950, plus Metro PCS will contribute <br />for the costs to maintain Santos Ranch Road (which the City owns). <br />
