CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-302 <br /> <br /> RESOLUTION APPROVING THE APPEAL OF STEVEN MCLEOD <br /> ALLOWING A SINGLE-FAMILY RESIDENTIAL USE WITHOUT THE <br /> REQUIRED COVERED PARKING SPACES AT 1358 SANTA RITA ROAD <br /> (AP-85-5) <br /> <br />WHEREAS, at its meeting of May 22, 1985, the Board of Adjustment <br /> denied case V-85-17, denying a request for a variance <br /> from the requirement for covered parking for a <br /> single-family residential use; and <br /> <br />WHEREAS, within the time specified by the Ordinance Code of the <br /> City of Pleasanton, the applicant, Steven McLeod, <br /> submitted an appeal to the City Clerk of the City of <br /> Pleasanton; and <br /> <br />WHEREAS, at its meeting of June 18, 1985, the City Council <br /> reviewed a report (SR 85:288) from the Director of <br /> Planning and Community Development, together with copies <br /> of staff reports to the Board of Adjustment regarding <br /> this matter; and <br /> <br />WHEREAS, a duly noticed public hearing was held at which time <br /> applicant and any other member of the public was offered <br /> an opportunity to present evidence regarding this <br /> appeal; and <br /> <br />WHEREAS, after a review of the material presented, the City <br /> Council makes the following findings: <br /> <br /> a. That because of special circumstances applicable to <br /> the property, including size, shape, topography, <br /> location or surroundings, the strict application of <br /> the provision of the ordinance deprives such <br /> property of privileges enjoyed by other properties <br /> in the vicinity and under identical zoning <br /> classification; <br /> <br /> b. That the granting of the variance will not <br /> constitute a grant of special privilege <br /> inconsistent with the limitation on other <br /> properties classified in the same zoning district; <br /> <br /> c. That the granting of the variance will not be <br /> detrimental to the public health, safety, or <br /> welfare, or materially injurious to properties or <br /> improvements in the vicinity; <br /> <br /> d. That neither present nor anticipated future traffic <br /> volumes generated by the use of the site or the <br /> <br /> <br />
