CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-289 <br /> <br /> APPROVAL OF LOW-INCOME HOUSING EXEMPTION FOR JOHN <br /> CAROLINE (PUD-84-7) <br /> <br />WHEREAS, John Caroline has requested a lower-income housing <br /> exemption under Section 2-20.04 of the Growth Management <br /> Program for five units of a 19-unit residential project <br /> at the intersection of Vineyard Avenue and Mavis Drive; <br /> and <br /> <br />WHEREAS, currently the City has 32 units remaining in the <br /> lower-income set aside under the Growth Management <br /> Program; and <br /> <br />WHEREAS, the Director of Planning and Community Development <br /> presented his report (SR 85:281) regarding the request <br /> from John Caroline which analyzed the request and made <br /> several recommendations; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the request for exemption from the Growth <br /> Management Program, Low-Income Set Aside Units, from <br /> John Caroline (PUD-84-7), subject to the following <br /> conditions: <br /> <br /> 1. that the five designated lower-income units shall <br /> be subject to rent limitation for at least fifteen <br /> (15) years; <br /> <br /> 2. rent adjustments may be allowed annually based upon <br /> HUD income guidelines; <br /> <br /> 3. that at least three of the five units shall be <br /> three-bedroom units; <br /> <br /> 4. the developer and his successors shall be <br /> responsible for yearly status reports on the <br /> administration of the lower-income units within the <br /> project;' such reports will include information on <br /> occupancy and income of tenants; <br /> <br /> 5. that the exemption shall lapse eighteen (18) months <br /> from the date of approval unless construction has <br /> commenced on any building in the project; <br /> <br /> 6. that the agreement shall run with the land; and <br /> <br /> <br />
