WHEREAS, of the total 308 RDE capacity desired for the CSA, 183 are <br /> <br /> currently flowing; and <br /> <br /> WHEREAS, capacity for the CSA has not been provided within existing DSRSD <br /> <br /> and LAVWMA facilities, except for 39,000 GPD ADMM, and expansion of these facilities <br /> <br /> is therefore necessary; and <br /> <br /> WHEREAS, DSRSD and LAVWMA have been studying alternatives to expansion <br /> <br />and have embarked on a program to expand the LAVWMA export facilities by approx- <br />imately 4.38 Million Gallon per'Day (MGD) ADMM, with the DSRSD treatment facilities <br />being expanded proportionately to accommodate DSRSD's and the City's allocated <br />capacities within the LAWWMA expansion; and <br /> <br /> WHEREAS, County desires City to provide CSA a fixed amount of sewage <br /> <br />treatment and disposal capacity from City's entitle merits in the DSRSD treatment <br />plant and LAVWMA export disposal facility in the event the LAVWMA export facility's <br />capacity is expanded by 438 MGD and the County is willing to pay its prorated <br />share of the City's cost of the 4.38 MGD LAVWMA expansion and the corresponding <br />increase in capacity of the DSRSD sewage treatment plant; and <br /> <br /> WHEREAS, City's West Pleasanton Interceptor Sewer was constructed by <br /> <br />an assessment district including the territory of the CSA and was designed to <br />accept a certain number of residential units for sewage from that territory <br />presently in the CSA; and <br /> <br /> WHEREAS, CSA has developed plans and specifications to the satisfaction <br /> <br />of City for the connection to the West Pleasanton Interceptor Sewer; and <br /> <br /> WHEREAS, upon expansion of the LAVWMA and DSRSD facilities, the City will <br /> <br />have capacity within its collection (West Pleasanton Interceptor Sewer), treatment <br />(DSRSD treatment plant), and export disposal (LAVWMA facilities) facilities to <br />serve the CSA; <br /> <br /> NOW, THEREFORE, the parties agree as follows: <br /> <br /> 1. Connection to West Pleasanton Interceptor Sewer. County will construct, <br /> <br />or have constructed, and pay all costs of constructing sewer facilities between <br />the existing Castlewood collection system and the southerly terminus of the West <br />Pleasanton Interceptor Sewer System, including all connections to the West Pleasanton <br />Interceptor Sewer, said construction being done in conformance with City approved <br />plans and specifications. <br /> <br /> 2 <br /> <br /> <br />
