LICENSE AGREEMENT <br /> <br /> 1. This Agreement made this day of , 1985, by <br /> <br />and between the City of P~easanton, a Municipal corporation, <br />(!icensor) hereinafter referred to "City" and Devor Nurseries, Inc. <br />(licensee) hereinafter referred to as "Devor". <br /> <br /> WHEREAS, Devor is the owner of certain real property, more speci- <br />fically described in Exhibit "A" attached hereto and made a part <br />hereof and; <br /> <br /> WHEREAS, Devor and City have exchanged Quitclaim Deeds whereby <br />Devor has released and quitclaimed to City the subterranean waters <br />lying beneath that certain real property d~scribed in Exhibit "A" and <br />the City of Pleasanton has released and quitclaimed to Devor surface <br />entry rights and easements, if any, related to the extraction of <br />water, lying beneath that real property described in Exhibit "A" and; <br /> <br /> ~EREAS, Devor wishes to retain the right to extract subter- <br /> <br />ranean waters through its existing well on the property described in <br /> <br />Exhibit "A" for a period of TEN (10) years and; <br /> WHEREAS, the City consents to said extraction. <br /> NOW THEREFORE IT IS AGREED AS FOLLOWS: <br /> <br /> 1. City grants to Devor the right to extract water from its <br />existing well for the benefit of all or any part of the property <br />described in Exhibit "A" for domestic, commercial, agricultural and <br />related purposes (including, but not limited to, office and manager's <br />residence). <br /> <br /> 2. Should the water level underlying the property described in <br />Exhibit "A" lower to such a depth as to materially decrease the supply <br /> <br /> 1 <br /> <br /> <br />
