CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-274 <br /> <br /> ACCEPTANCE OF QUITCLAIM DEED FOR SUBTERRANEAN WATER AND <br /> QUITCLAIM OF CITY RIGHTS OF SURFACE ENTRY FOR PARCEL 1 <br /> OF PARCEL MAP 1339 (DEVOR NURSERIES) <br /> <br />WHEREAS, the City is in receipt of a Quitclaim Deed from Devor <br /> Nurseries, Inc. to the City of Pleasanton for <br /> subterranean waters, without rights of surface entry, <br /> which is given in exchange for a Quitclaim Deed from the <br /> City of Pleasanton to DeVor Nurseries, Inc. for surface <br /> entry rights and easements, if any, related to the <br /> extraction of water; and <br /> <br />WHEREAS, at its meeting of June 4, 1985, the City Council <br /> received a report from the Director of Public Works and <br /> Utilities indicating that the exchange of these deeds is <br /> in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the Mayor to execute the Quitclaim Deed <br /> from the City of Pleasanton to DeVor Nurseries, Inc. for <br /> surface entry rights and easements, if any, related to <br /> the extraction of water in Parcel 1 of Parcel Map 1339. <br /> <br />Section 2: Accepts a Quitclaim Deed from DeVor Nurseries, Inc. <br /> to the City of Pleasanton for subterranean waters, <br /> without rights of surface entry for Parcel 1 of Parcel <br /> Map 1339, and the appropriate City officers are <br /> instructed to take whatever action necessary to <br /> implement said acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JUNE 4, 1985 BY THE FOLLOWING VOTE: <br /> <br /> <br />
