Property, unless and until the conditions of this Agreement <br />have been met. <br /> <br /> D. "Owner" shall mean Crow and its successors and <br /> <br />assigns that become the owner of the Property or any portion <br />thereof. <br /> <br /> NOW, THEREFORE, in consideration of the mutual <br /> <br />covenants and agreements contained herein, the parties do <br />hereby agree as follows: <br /> <br /> 1. ~Building Permit Limitation. Owner's right to <br /> <br />obtain building permits shall be subject to the provisions <br /> <br />of this paragraph. <br /> <br /> (a) Traffic Study. Each request for design <br />review approval submitted to the City with respect to all or <br />a portion of the Property ("Project") shall be accompanied <br />by a traffic study analysis, projecting future levels of <br />service at the intersections listed on Exhibit B, attached <br />here to ("affected intersections"). Future traffic <br />conditions shall include existing traffic, projected traffic <br />from other projects under construction and/or projects <br />having received final City Approvals and scheduled for <br />construction and, projected traffic from the Project <br />submitted for approval. The street network assumed shall be <br />that existing at the time the Project is submitted for <br />approval and as it will exist as the result of roadway <br />improvements either under construction or, if requiring only <br /> <br /> -2- <br /> <br /> <br />
