IN LIEU PARKING AGREEMENT <br /> <br /> THIS IN LIEU PARKING AGREEMENT ("Agreement") is entered into <br /> <br /> this 21st d<~y of May, 1985, by and between the CITY OF <br /> PLEASANTON, a municipal corporation, ("City"), and HOPYARD <br /> PARTNERS, a California limited partnership ("Owner"). <br /> <br /> THE PARTIES ENTER THIS AGREEMENT on the basis of the <br /> <br /> following facts, understandings and intentions: <br /> <br /> A. Owner owns certain real property located in the City of <br /> Pleasanton, County of Alameda, State of California, consisting of <br /> approximately 4.5 acres at the northeast corner of Hopyard Road <br /> and Valley Avenue and comprising Assessor's Parcels 946-3215-15 <br /> through 21, inclusive ("Property"). The Property is more <br /> particularly described in Exhibit A, attached hereto. <br /> <br /> B. The Hopyard Shopping Center ("Hopyard Center") is <br /> <br />located on the Property, which is zoned as a Central Commercial <br />(C-C) District, and is an approximately sixty-five thousand two <br />hundred ten (65,210) square foot mixed use development, including <br />retail, restaurant and office uses. <br /> <br /> C. Approximately sixty-three percent (63%) of Hopyard <br /> <br />Center, consisting of approximately forty-one thousand eighty-two <br />(41,082) square feet, currently is leased and is hereinafter <br />referred to as the "Leased Area." <br /> <br /> D. Hopyard Center contains two hundred and four (204) <br /> <br />parking spaces. In accordance with the current parking <br />requirements of the City's zoning ordinance, two hundred and <br />three (203) of the spaces are required to fulfill parking <br />requirements for the Leased Area; only one (1) parking space <br /> <br /> - 1 - <br /> <br /> <br />
