ATTACHMENT 1 <br />RESOLUTION NO. 08- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING A GENERAL PLAN AMENDMENT FOR THE APPLICATION OF <br />WINDSTAR COMMUNITIES, INC., AS FILED UNDER CASE PGPA-13 <br />WHEREAS, at its meeting of September 2, 2008, the City Council received an <br />application from Windstar Communities, Inc. for General Plan Amendment to change the <br />General Plan Land Use Designation of the BART-owned property located at <br />6110 Stoneridge Mall Road, adjacent to the future West Dublin/Pleasanton BART station, <br />to add "High Density Residential" to the existing "Retail/Highway/Service Commercial; <br />Business and Professional Offices" designation; and <br />WHEREAS, the Planning Commission held a public hearing on the proposed <br />change and made recommendations to the City Council; and <br />WHEREAS, based on the Initial Environmental Study, a Negative Declaration <br />was adopted by the City Council on September 2, 2008; and <br />WHEREAS, the City Council held a public hearing on September 2, 2008 with <br />respect to the General Plan Amendment; and <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />SECTION 1. The City Council approves the application of. Windstar Communities, <br />Inc. for General Plan Amendment to change the General Plan Land Use Designation of <br />the BART-owned property located at 6110 Stoneridge Mall Road, adjacent to the future <br />West Dublin/Pleasanton BART station, to add "High Density Residential" to the existing <br />"Retail/Highway/Service Commercial; Business and Professional Offices" designation, as <br />shown on the attached Exhibit A, PGPA-13, General Plan Amendment Map, dated <br />October 2, 2008, and incorporated herein by this reference. <br />SECTION 2. The City determines that this is one of the four times in 2008 that <br />the Land Use Element of the General Plan may be amended as provided in <br />Government Code Section 65631. <br />SECTION 3. This resolution shall become effective immediately upon its <br />passage and adoption. <br />PASSED, APPROVED, AND ADOPTED by the City Council of the City of <br />Pleasanton at a regular meeting held on September 2, 2008. <br />
