CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-247 <br /> <br /> APPROVAL OF LOW-INCOME HOUSING EXEMPTION FROM THE GROWTH <br /> MANAGEMENT PROGRAM FOR MICHAEL O'CALLAGHAN (Z-85-6) <br /> <br /> WHEREAS, Michael O'Callaghan has requested a lower-income housing <br /> exemption under Section 2-20.04 of the Growth Management <br /> Ordinance for three units of a ten unit residential <br /> project at 4324 Railroad Street; and <br /> <br /> WHEREAS, currently the City has 35 units remaining in the lower <br /> income set aside under the Growth Management Program; <br /> and <br /> <br /> WHEREAS, the Director of Planning and Community Development <br /> presented his report (SR 85:216) regarding the request <br /> from Michael O'Callaghan which analyzed the request and <br /> made several recommendations; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Approves the request for exemption from the Growth <br /> Management Program, low-income set-aside units, of <br /> Michael O'Callaghan, Z-85-60, which would allow <br /> construction of the entire 10-unit complex, and directs <br /> that an agreement be prepared by the City Attorney's <br /> office which includes the following elements. <br /> <br /> 1. That the three designated lower-income units shall <br /> be subject to rent limitation for at least fifteen <br /> (15) years; <br /> <br /> 2. Rent adjustments may be allowed annually based upon <br /> HUD income guidelines; <br /> <br /> 3. The developer and his successors shall be <br /> responsible for yearly status reports on the <br /> administration of the lower-income units within the <br /> project; such reports will include information on <br /> occupanqy and income of tenants; <br /> <br /> 4. That the exemption shall lapse eighteen (18) months <br /> from the date of approval unless construction has <br /> commenced on any building on the project; and <br /> <br /> 5. That the agreement shall run with the land. <br /> <br />Section 2: Authorizes the Mayor to execute the above-described <br /> agreement. <br /> <br /> <br />
