ORDINANCE NO. 1982 <br />AN ORDINANCE APPROVING THE APPLICATION OF JIM HAPP AND KENNETH AND <br />PAMELA CHRISMAN FOR A PUD MAJOR MODIFICATION, AS FILED UNDER <br />CASE PUD-05-02M <br />WHEREAS, Jim Happ and Kenneth & Pamela Chrisman have applied fora major <br />modification to an approved Planned Unit Development (PUD) development plan to replace the <br />approved production home designs with design guidelines for the property located on the south side <br />of Vineyard Avenue Trail (formerly known as 1944 Vineyard Avenue), in the Vineyard Avenue <br />Corridor Specific Plan Area; and <br />WHEREAS, zoning for the property is PUD-A/OS/LDR (Planned Unit Development - <br />Agriculture/Open Space/Low Density Residential) District; and <br />WHEREAS, an environmental review for the proposed project was undertaken with the <br />Environmental Impact Report (EIR) for the Vineyard Avenue Corridor Specific Plan, certified by the <br />City Council on March 1999; and <br />WHEREAS, there are no substantial changes to the project or to the circumstances under <br />which the project is undertaken that involve new significant environmental effects or substantially <br />increase the severity of previously identified effects, and there is no new information of substantial <br />importance not known at the time the EIR was certified regarding the projects or its effects, mitigation <br />measures, or alternatives; therefore, no additional environmental documentation was prepared for <br />this application; and <br />WHEREAS, at its meeting of February 27, 2008, the Planning Commission recommended <br />approval of the modification to the PUD development plan; and <br />WHEREAS, a duly noticed public hearing was held on August 19, 2008; and <br />WHEREAS, the City Council finds that the PUD major modification is consistent with the <br />General Plan policies and the purposes of the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Approves the application of Jim Happ and Kenneth & Pamela Chrisman for a <br />major modification to an approved Planned Unit Development (PUD) development plan to replace the <br />approved production home designs with design guidelines for the property located on the south side <br />of Vineyard Avenue Trail (formerly known as 1944 Vineyard Avenue), in the Vineyard Avenue <br />Corridor Specific Plan Area, subject to the conditions shown on Exhibit B, attached hereto and <br />incorporated herein by this reference. <br />Section 2. A summary of this ordinance shall be published once within fifteen (15) days <br />after its adoption in "The Valley Times," a newspaper of general circulation published in the City of <br />Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office <br />within fifteen (15) days after its adoption. <br />
