standards EBDA must meet for discharge into the bay. A report as to quality <br />of samples collected shall be made to EBDA within 10 days after the end of <br />each calendar month and within 10 days of a request from EBDA for sampling and <br />testing to identify a wastewater discharge requirement violation in accordance <br />with applicable and current testing and laboratory procedures. In addition, <br />LAVW~A shall measure the instantaneous rate of flow, totalized flow, chlorine <br />residual and pressure in its pip~line and shall transmit that data to an EBDA <br />operations center, in a form compatible with EBDA's permanent..data collection <br />system. <br /> <br /> LAVWMA shall monitor any discharge it makes into the tidal waters of San <br />Lorenzo Creek due to overflow conditions and report the quantity and quality <br />of such released wastewater to the Regional Water Resources Control Board. <br /> <br /> EBDA shall monitor the outfall effluent discharge and receiving waters in <br />accordance with procedures and requirements of the appropriate regulatory <br />agencies. <br /> <br /> 8. Ownership of Wastewater: LAVWMA shall retain ownership of that <br /> <br />party's wastewater until said wastewater is discharged into EBDA's interceptor <br />system; at said time EBDA shall obtain title to said wastewater. <br /> <br /> 9. Failure to Meet Discharge Requirements: LAVWMA shall report to EBDA <br /> <br />as soon as possible, but within 24 hours, any v~olations of the applicable <br />~,~astewater discharge requirements. A written statement of the probable cause <br />and the nature and time schedule for corrective action being taken or to be <br />taken shall be furnished to EBDA as soon as practicable. <br /> <br /> LAVWMA shall hold EBDA harmless from all liability and/or damages <br /> <br />incurred by EBDA as a direct and proximate result of any failure by [AVWMA to <br />meet the aforementioned discharge requirements, including but not limited to, <br />~egal, engineering and administrative expenses, fines and damage incurred by <br />EBDA as a result of a cease and desist order or court injunction from any <br /> <br /> -5- <br /> <br /> <br />
