This Agreement made this day of , <br /> <br />1985, by and between EAST BAY DISCHARGERS AUTHORITY, A Joint Powers Agency, <br />hereinafter referred to as "EBDA" and LIVERMORE-AMADOR VALLEY %4ATER MANAGEMENT <br />AGE?~C~, A Joint Powers Agency, hereinafter referred to as "LAVWMA": <br /> <br /> 14HEREAS, EBDA is a Joint Powers Agency comprising the following political <br />subdivisions: City of Hayward, City of San Leandro, Union Sanitary District, <br />Oro Loma Sanitary District, Casino Valley Sanitary District;and <br /> <br /> WHEREAS, EBDA operates and maintains an interceptor-outfall system <br /> <br />extending from Southern Alameda County to a deep-water bay discharge in the <br />San Francisco Bay which receives and discharges treated wastewater from the <br />five political subdivisions comprising EBDA in compliance with]federal' and <br />state water quality requirements; and <br /> <br /> WHEREAS, LAVWMA is a Joint Powers Agency comprising the following <br /> <br />political subdivisions: City of Livermore, City of Pleasanton, Dublin San <br /> <br />Ramon Services District; and <br /> <br /> WHEREAS, LAVWMA has determined that the most cost-effective manner of <br />exporting its effluent for bay disposal is ~hrough connection with EBDA's <br />interceptor at a point about one mile north of EBDA's Oro Loma Pump Station; <br />and <br /> <br /> WHEREAS, an Agreement dated February 1, 1978, and amended March 26, 198I, <br />authorized LAVW~A to discharge 19.72 million gallons per day (mgd) of.effluent <br />into EBDA's system and to compensate EBDA by paying 10.43% of the fixed O&M <br />costs plus a portion of the variable costs considering the flow and residual <br />chlorine concentration; and <br /> <br /> WHEREAS, LAVWMA has proposed to increase its pumping capacity to 21 mgd <br /> <br />to meet the present needs of its political subdivisions, or 1.28 mgd more than <br /> <br />it is authorized to export under the aforementioned Agreement; and <br /> <br /> -1- <br /> <br /> <br />
