C. Under the special District proceedings referred to above, all <br /> of the Gas Facilities, as shown on Exhibit "A", to be installed within the <br /> District shall be constructed by PGandE. <br /> <br /> D. The ownership of the Gas Facilities installed by PGandE shall <br />vest in PGandE in accordance with the provisions of Sections 10109, 10110 and <br /> <br />10111 of the Streets and Highways Code of the State of California. <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> 1. PGandE shall furnish and install the Gas Facilities shown on <br />Exhibit "A" in accordance with Section C of PGandE's Gas Rule No. 15 (Gas <br /> <br />Extension Rule), a copy of which is attached hereto and made a part hereof. <br /> 2. The Gas Facilities to be installed hereunder shall be designed <br /> <br />to meet estimated gas loads within the District. <br /> <br /> 3. City shall pay to PGandE upon demand and in advance of <br />construction of the requested Gas Facilities a refundable amount of $1,813 <br />(Gas Extension Advance) which represents the total cost of the Gas Facilities <br />($14,490) less a credit for the gas share of the trench of $12,677, which <br />trenching shall be performed by City in accordance with PGandE's plans and <br />specifications. City shall pay PGandE the nonrefundable amount of $141 to <br />inspect the trench work performed by City. <br /> <br /> 4. (a) In accordance with PGandE's Gas Rule 16, copy attached and <br />made a part hereof, City shall pay to PGandE $4,325.50 for the installation of <br />1,055 feet of excess gas service pipe (at $4.10 per foot) te the various <br />buildings as described on Exhibit "A". <br /> <br /> 2.' <br /> <br /> <br />
