idop~d by the City Council ot the City of RESOLUTION NO. 85-214 Ci~ Clerk RESOLUTION VACATINC PORTIONS OF HOPYARD ROAD NORTH OF OWENS DRIVE WHEREAS, on May 7, 1985, the City Council received a staff report recommending the vacation of portions of Old Hopyard Road north of Owens Drive, more par~cu]ar]_y described .in Exhibit A, attached hereto and incorporated herein by this reference; and WHEREAS, the proposed vacation of Old Hopyard Road is consistent with the goals'and policies of the General Plan as the street has been relocated and renamed Owens Court; and WHEREAS, the superseded portion of Old Hopyard Road is no longer necessary for present or prospective public use due to relocation of the street; and WHEREAS, access will not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and WHEREAS, vacation of the street will not terminate a public service easement; and WHEREAS, there is in place public utility facilities which are in use, and public convenience and necessity require the reservation of easements for these utility facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the relocation of Old Hopyard Road in a manner meeting the requirements of Section 8330 of the Streets and Highways Code, those portions of Old Hopyard Road described in Exhibit "A" are hereby vacated. Section 2: That public service easement shown on Exhibit A shall be reserved from the vacation of the relocated street. Section 3: The clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Alameda County Recorder and from and after the date of recording the above-described portions of Old Hopyard Road shall no longer constitute a street. Section 4: This resolution shall become effective immediately upon its passage and adoption.
