idop~d by the City Council ot the City of <br /> <br /> RESOLUTION NO. 85-214 Ci~ Clerk <br /> <br /> RESOLUTION VACATINC PORTIONS OF HOPYARD ROAD NORTH OF <br /> OWENS DRIVE <br /> <br />WHEREAS, on May 7, 1985, the City Council received a staff report <br /> recommending the vacation of portions of Old Hopyard <br /> Road north of Owens Drive, more par~cu]ar]_y described <br /> .in Exhibit A, attached hereto and incorporated herein by <br /> this reference; and <br /> <br />WHEREAS, the proposed vacation of Old Hopyard Road is consistent <br /> with the goals'and policies of the General Plan as the <br /> street has been relocated and renamed Owens Court; and <br /> <br />WHEREAS, the superseded portion of Old Hopyard Road is no longer <br /> necessary for present or prospective public use due to <br /> relocation of the street; and <br /> <br />WHEREAS, access will not be cut off to any person's property <br /> which, prior to relocation, adjoined the street being <br /> vacated; and <br /> <br />WHEREAS, vacation of the street will not terminate a public <br /> service easement; and <br /> <br />WHEREAS, there is in place public utility facilities which are in <br /> use, and public convenience and necessity require the <br /> reservation of easements for these utility facilities; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> relocation of Old Hopyard Road in a manner meeting the <br /> requirements of Section 8330 of the Streets and Highways <br /> Code, those portions of Old Hopyard Road described in <br /> Exhibit "A" are hereby vacated. <br /> <br />Section 2: That public service easement shown on Exhibit A shall be reserved from the vacation of the relocated street. <br /> <br />Section 3: The clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder and from and after the date <br /> of recording the above-described portions of Old Hopyard <br /> Road shall no longer constitute a street. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
