CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> COUNTY OF ALAMEDA, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-212 <br /> <br /> RESOLUTION APPROVING AGREEMENT WITH MOLLERS FOR PURCHASE <br /> OF 2.004 ACRES AND ACCEPTING DEED <br /> <br />WHEREAS, in connection with the enlargement of the Foothill <br /> Reservoir, it was necessary to obtain an additional <br /> 2.004 acres from the Mollers for the reservoir site; and <br /> <br />WHEREAS, construction is still on-going and it is necessary to <br /> extend the termination date of the right-of-entry <br /> agreement; <br /> <br />WHEREAS, City Council reviewed a staff report (SR 85:211) from <br /> the City Attorney's office outlining in detail the <br /> necessary transactions; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the agreement between the City of Pleasanton <br /> and Harold H. Moller, Evelyn B. Moller and Lloyd M. <br /> Moller, regarding acquisition of 2.004 acres, a copy of <br /> which is attached hereto and incorporated herein by this <br /> reference. <br /> <br />Section 2: Authorizes the Mayor to execute the above-described <br /> agreement. <br /> <br />Section 3: Accepts the Deed for the 2.004 acre parcel. <br /> <br />Section 4: The appropriate City officers are instructed to take <br /> whatever action necessary to implement the <br /> above-described agreement. <br /> <br />Section 5: Approves the extension of the termination date in the <br /> October 25, 1983 Right-of-Entry Agreement to July 1, <br /> 1985. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED MAY 7, 1985 BY THE FOLLOWING VOTE: <br /> <br /> <br />
