ATTACHMENT 4 CONTRACT ANNUAL WATER REPLACEMENTS PROJECT N0.071028 THIS CONTRACT is made and entered into this 2"d day of September, 2008 by and between D&D PIPELINES, INC., ("Contractor"), whose address is 629 Divisadero Street, San Francisco, CA 94117 with telephone number (415) 441-2006, and the CITY OF PLEASANTON, a municipal corporation ("City"). WITNESSETH: WHEREAS, the City has awarded to the Contractor a contract for Annual Water Replacements, Project No.071028. NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: Work to be Performed. The subject project consists of providing traffic control; providing and implementing water pollution control measures; potholing operations; installing new water main, water main bypass jumper, water service connections, and various related appurtenances along Fair Oaks Court and Virgin Islands Court. Said work is more particularly shown in the following documents which are on file with the Department of Public Works of the City and are incorporated herein by this reference: A. Plans and Specifications entitled the Annual Water Replacement, Project No.071028, and addenda thereto, if any. B. Contract Change Orders approved by the City Engineer, done in accordance with the Standard Specifications. C. The elements of the proposal submitted to the City by the Contractor, which the City has accepted. 2. Compensation. The City shall pay the Contractor for work actually performed at the unit prices set out in the Contractor's proposal to the City. The quantities of work stated therein are estimates only; actual quantities will be measured for payment in accordance with the specifications.
