3. Contractor shall keep an accurate acco~mting of the cost <br /> <br />of abatement in front of orion each separate parcel. of property where <br />work is done by him, and shall, upon completion of said weed abate- <br />ment work, submit to the City Council an itemized written report <br />showing such cost. <br /> <br /> 4. City shall, no less frequently than at two week intervals <br />throughout the term herein, inspect the work-done by Contractor herein <br />and upon recommendation of the Fire Department pay to Contractor <br />an amount of money consistent with the work done during the preceding <br />two weeks at the rate provided for in'the Weed Abatement Program bid <br />sheet. <br /> <br /> 5. City shall, upon completion of weed abatement and confirma- <br />tion of cost thereof and-upon recommendation of the Fire Prevention <br />Officer of acceptance of the work by the City, pay to Contractor that <br />amount of money which remains after compliance ~ith the provisions of <br />Paragraph 4 hereof. <br /> <br /> 6. Contractor agrees to indemnify and to save and hold harm- <br />less from and defend the City, members of the City Council and their <br />agents, servants and employees, against any and all claims, costs, <br />~emands, causes of action, suits, losses', expenses or other detriment <br />or liability arising from or out of acts or omissions of Contractor, <br />his agents, officers or employees, in connection with this agreement <br />or any amendment thereto. <br /> <br /> 7. Independent Contractor. City retains Contractor as an <br />independent contractor and not as an employee of City. As an inde- <br />pendent contractor, Contractor's agents and employees shall be the o~ <br />sole responsibility of Contractor and shall not be deemed to fall <br />within any of the personnel provisions governing City employees. <br /> <br /> -2- <br /> <br /> <br />
