CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-148 <br /> <br /> RESOLUTION APPROVING SETTLEMENT OF PERRY ESTATE <br /> CONDEMNATION <br /> <br />WHEREAS, in conjunction with the railroad consolidation project, <br /> it was necessary to acquire 72,437 sq. ft. of property <br /> owned by the Estate of Mrs. Perry and occupied by Goe <br /> Auto; and <br /> <br />WHEREAS, a settlement has been reached with the representatives <br /> of the estate of Mrs. Perry and Thornley Goe; and <br /> <br />WHEREAS, the Assistant City Attorney presented a staff report (SR <br /> 85:151) outlining in detail the terms of the settlement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the attached draft Compromise Settlement and <br /> Mutual Release Agreement and authorizes the Mayor to <br /> execute it. <br /> <br />Section 2: Accepts the approximately 72,437 sq. ft. parcel of <br /> land from the estate of Mrs. Perry. <br /> <br />Section 3: Authorizes the City Attorney to secure title <br /> insurance and do all things necessary to finalize this <br /> acquisition and to dismiss the complaint in eminent <br /> domain. <br /> <br />Section 4: Directs the Assistant City Manager to appropriate <br /> additional funds to the railroad consolidation fund <br /> account sufficient to cover the full acquisition cost at <br /> the time escrow closes. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED MARCH 26, 1985 BY THE FOLLOWING VOTE: <br /> <br /> <br />
