Acting Chair Pearce believed it was preferable to have more direct language in the <br />resolutions that would direct the City to take a specific action, rather than language more <br />suitable for a General Plan. <br />Commissioner O'Connor understood that the legal language existed that it was within the <br />City's purview to compel. <br />Commissioner Fox moved to make the finding that the proposed modification is <br />covered by the previously approved Final Environmental Impact Report for the <br />Vineyard Avenue Corridor Specific Plan and that no additional environmental <br />review is needed; to make the finding as listed in Exhibit E that the proposed <br />modification is covered by the previously approved PUD development plan findings <br />for PUD-O5; and to recommend approval of the proposed modification subject to <br />Exhibit B, Draft Conditions of Approval, of the staff report, with the following <br />modifications: <br />1. Delete Condition No. 16 as it duplicates Condition No. 17; <br />2. Modify Condition No. 19 to state that the maximum FAR allowed would be <br />consistent with the original Centex approvals for all lots; <br />3. Modify Condition No. 23 to state that as part of the improvements for the <br />project, the applicant shall relinquish easement rights to the well located on <br />the Brozosky property when the connection to City water is made. <br />Commissioner O'Connor seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Fox and O'Connor. <br />NOES: Commissioners Narum, Olson, and Pearce. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioner Blank. <br />The motion failed. <br />Commissioner Olson moved to make the finding that the proposed modification is <br />covered by the previously approved Final Environmental Impact Report for the <br />Vineyard Avenue Corridor Specific Plan and that no additiona- environmental <br />review is needed; to make the finding as listed in Exhibit E that the proposed <br />modification is covered by the previously approved PUD development plan findings <br />for PUD-O5; and to recommend approval of the proposed modification to the City <br />Council, subject to Exhibit B, Draft Conditions of Approval, of the staff report, with <br />the following modifications: <br />1.
